Medical research data is sensitive personal data that needs to be protected from unauthorized access and unintentional disclosure. In a research setting, sharing of data within the scientific community is necessary in order to make progress and maximize scientific benefits derived from valuable and costly data. At the same time, convincingly protecting the privacy of people participating in medical research is a prerequisite for maintaining trust and willingness to share. In this commentary, we will address this issue and the pitfalls (...) involved in the context of the PEP project1 that provides the infrastructure for the Personalized Parkinson’s Project,2 a large cohort study on Parkinson’s disease from Radboud University Medical Center, in cooperation with Verily life Sciences, an Alphabet subsidiary. La réflexion philosophique, dont l'ouverture à l'univers dans lequel nous nous découvrons - avec une acuité proportionnelle à un étonnement renouvelé - n'a pas de limites, n'en est que plus tributaire des sciences et des techniques, des arts et de multiples activités qui régissent plus ou moins fructueusement notre expérience. Or, au sein des sciences humaines, privilégiées pour éclairer une condition que nous ne saurions cesser d'interpréter, peu d'oeuvres du dernier siècle auront enrichi en le précisant notre être-au-monde, comme la (...) théorie linguistique de Gustave Guillaume, assez solitaire, et les recherches multiformes de Jean Piaget - où la psychologie de l'enfant a souvent occulté la visée épistémologique et son enracinement biologique (cf Biologie et connaissance, 1967) et ses prolongements pédagogiques, voire éthiques. Le Cinquantenaire et le Trentenaire de leur disparition appelaient un hommage d'autant plus impératif qu'ils sont restés marginaux ou ignorés dans les milieux philosophiques, malgré la centralité de leurs élucidations. Leur commune orientation génétique et structurale n'ayant suscité aucun échange, pendant la contemporanéité de publications d'un tiers de siècle (1923-1960), mesurer leur complémentarité s'impose d'autant plus. S'ils peuvent aider à repenser la condition humaine, c'est qu'ils auront contribué à dissiper le "mystère de la pensée". L'un cherchant à habiliter les caractères systématique et cinétique des langues, irremplaçables moyens de penser ; l'autre dans un vis-à-vis cognitif et opératoire de Freud, en relavant sur les plans épistémologique et logique, notamment, l'élan révolutionnaire de la seconde modernité, autour de l'évolutionnisme. Mais les thèmes majeurs du constructivisme, du schème et de la symbolisation - et plus largement du temps et du langage - auront sans doute aidé à spécifier les mutations autorisées par la révolution critique. Entre l'Instant du je parle et un décentrement exigible pratiquement (éthique) comme théoriquement (épistémique), c'est bien la condition humaine dans son ensemble qui est concernée. Si repenser cette Condition s'impose en permanence, il importe de ne pas manquer des oeuvres qui, par-delà toute mode, proposent à notre expérience des fondations résistant à d'inéluctables vicissitudes. Sa ronflante Méthode, qui établit que les effets d’une action échappent souvent à son auteur en provoquant des conséquences méconnues, comble surtout des médias trop heureux d’avoir sous la main un théoricien tout-terrain aux analyses grandiloquentes. D’ailleurs, la femme, l’entreprise, le football, la France, l’Europe, les pays de l’est, les pays arabes, le monde... sont, pour Edgar Morin, complexes. En quelques années, Edgar (...) Morin a ainsi réussi à amener la gauche à jeter Marx et ses analyses tranchées aux poubelles de l’Histoire. Car avec Edgar Morin, c’est beaucoup plus complexe et parfois même un tantinet ésotérique. In the Canadian forensic psychiatric context, the concepts of risk and dangerousness interact, intersect, and morph into the notion of significant threat to the safety of the public. Stemming from the results of a critical ethnography of the Ontario Review Board, this article unpacks the central role of forensic psychiatric nursing, as an example of a 'psych' discipline (e.g., psychiatry and psychology), in a system that is built to produce risky persons and to legitimize their detention and supervision. By using (...) excerpt of interviews conducted with nurses, ethnographic observations of Review Board hearings, and other documentary artifacts, the findings illustrate how rationalizations of risk and dangerousness are contingent on space, time, and observer. Depending on the time of the assessment or on the health‐care professional who performs it, different elements including, but not limited to, mental illness, interpersonal relationships, financial instability, and sexual vulnerability, are relied upon in very fluid, interchangeable, and discretionary ways to justify findings of dangerousness. Such a dynamic expands the reach of psychiatry's legitimacy at identifying risky conduct and controlling risky persons to domains very loosely associated with the notion of dangerousness. The work of Foucault and Castel provides the theoretical backdrop on which rests the discussion and the implications for nursing. (shrink)

The purpose of this paper is to engage with the readers in a theoretical reflection on nursing practices in forensic psychiatric settings. In this paper, we argue that practices of exclusion in forensic psychiatric settings share some common ground with Agamben's description of sovereign power and, consequently, the possible creation of zones of exception in this environment. The concept of exception is, therefore, purposely used to shift our thinking, highlight the political forces surrounding exclusionary practices in forensic psychiatric nursing, and (...) explore the ethical tensions that arise for nurses who become entangled in the control of these zones of exception. We argue that ethical and political discussions regarding this phenomenon are necessary if we wish to further understand the complexities of this field of practice and promote constructive change. Background:Psychiatric nurses are regularly confronted with the uses and effects of control interventions such as mechanical restraints. Although there are evident tensions in the literature regarding the use of mechanical restraints, very little research has focused on the lived and embodied experience of their use, whether from the patient’s perspective or the perspective of nursing staff responsible for their application.Research aims: to gain access to the bodily phenomenon of being placed in mechanical restraints; to give voice to the intimate experiential (...) understanding of this experience; and through phenomenological interpretation, to understand the subjective processes and meaning-making of this experience.Research design:For this research, we adopted a distinctly ethics-oriented application of the methodology known as interpretative phenomenological analysis, that is, the interpretive dimension of the research focused on ethical practice in mental healthcare – one that is informed by experiential accounts of the lived body.Participants and research context:A total of 40 in-depth semi-structured, nondirected interviews with both nurses and patients we conducted to meet the aims of this article. Participants were recruited from an inpatient psychiatric unit of a Canadian general hospital.Ethical considerations:The research received research ethics board clearance from both the hospital where the study took place and the University of Ottawa.Findings:The comparative analysis is presented under the following headings: context of care, meaning of quality of care, emotional reactions and nurse–patient relationship, meeting the needs and need for alternatives.Discussion/conclusions:The research findings are discussed in light of current literature and implications for practice. Humanism in forensic psychiatry: the use of the tidal nursing model The humanist school of thought, which finds resonance in many conceptual models and theories designed to guide nursing practice, needs to be understood in the context of the total institution, where the individual is subjected to a mortification of the self, and denied autonomy. This article will engage in a critical reflection on how humanism has influenced nursing theorists and the subsequent production of conceptual models and theories, especially as (...) they relate to the field of forensic psychiatric nursing. Although humanism provides optimism for nurse–patient relations, this article explores the incapability of such a philosophy to acknowledge the power relationships between individuals and its inability to explain the day‐to‐day realities experienced in forensic nursing, where the possibility of interpersonal violence reshapes nursing care. The tidal model will be discussed in detail as an example of a recently developed humanistic nursing model. Viewed from this perspective, it is clear that humanistic philosophy and its subsequent models of care are in discordance with the highly specialized field of forensic nursing. (shrink)

Essentielle au droit, la question de la valeur n'a pourtant jamais été prise au sérieux. Et pour cause, dans le sillage des sciences empiriques, la pensée juridique moderne s'est accommodée d'une épistémologie d'après laquelle toute proposition juridique est réputée vraie ou fausse si elle décrit un état de chose « réel ». Conçu comme un ensemble de faits sociaux, objectivement identifiables, le droit s'appréhende comme une discipline promouvant des idéaux scientifiques, dont la neutralité axiologique de l'observateur. Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

In the opening essay of The Muses, Nancy asks what force disperses Art into a plurality of arts, and what simultaneously holds them together in the unity of Art, through this very dispersal. The idea of Art, as a plurality of irreducible singularities that nevertheless commune, developed in the essay, is a precursor to the ontology of Being Singular Plural, widely considered one of his most important works. The claim in The Muses is not only that art itself has to (...) be understood as a unity of a plurality of singularities, but that it is a privileged site for the revealing of the singular plural of being. The following essay explores Nancy’s ontology of art, which is simultaneously a way of understanding being in terms of art, by tracing it back to Merleau-Ponty. I argue that Merleau-Ponty’s understanding of the sense of being in terms of the “chiasm” (the touching-touched) in The Visible and the Invisible is a crucial source for Nancy’s pluralist ontology. The turn to Merleau-Ponty is framed as a way of emphasizing that Nancy remains committed to a philosophical or ontological idea of art (despite his own criticisms of the very idea) against those who would like to separate his pluralist idea of art from any reference to the question of the meaning of “being.” The argument is that radical pluralism requires, paradoxically, an ontology, just as the affirmation of the irreducible plurality of singular arts requires a notion of Art. Dans l’essai qui ouvre Les muses, Nancy se demande quelle force disperse l’Art dans les arts et retient simultanément leur dispersion dans l’unité de l’Art. L’idée d’Art en tant qu’une pluralité irréductible de singularités qui communient malgré ou grâce à cette pluralité, telle qu’elle est développée dans cet essai, constitue un précurseur de l’ontologie présentée dans Être singulier pluriel, un des ouvrages les plus importants de Nancy. Cet article explore l’ontologie de l’art nancéenne, qui est aussi à la fois une façon de comprendre l’être en tant qu’art, en en retraçant les racines chez Merleau-Ponty. Je soutiens que la compréhension du sens de l’être comme chiasme (touchant-touché) chez le Merleau-Ponty du Visible et l’invisible est une source décisive de l’ontologie pluraliste de Nancy. Le recours à Merleau-Ponty permet de souligner le fait que Nancy demeure attaché à une idée philosophique ou ontologique de l’art, malgré ses propres critiques de l’idée même. Cette interprétation va à l’encontre de celles qui chercheraient à détacher le concept pluraliste d’art chez Nancy de toute référence à la question du sens de l’« être ». Ma contention est que le pluralisme radical requiert, paradoxalement, une ontologie, de la même façon que l’affirmation de l’irréductible pluralité des arts singuliers requiert une notion d’Art.Nel saggio che apre Le muse, Nancy si domanda quale forza disperda l’Arte in una pluralità di arti, e cosa al contempo mantenga queste ultime legate nell’unità dell’Arte a dispetto di questa dispersione stessa. L’idea di Arte, sviluppata in questo saggio, come pluralità di singolarità irriducibili che nonostante tutto si trovano a contatto e in comunicazione, prelude all’ontologia di Essere singolare plurale, tra le opere più importanti di Nancy. Ne Le muse Nancy sostiene non soltanto che l’arte in sé debba essere concepita come l’unità di una pluralità di singolarità, ma anche che essa sia un luogo privilegiato per il rivelarsi del singolare plurale dell’essere. Questo articolo esplora l’ontologia dell’arte di Nancy, che è al contempo un modo di comprendere l’essere nei termini dell’arte, attraverso un richiamo a Merleau-Ponty. Mi propongo così di mostrare che la concezione del senso dell’essere di Merleau-Ponty nei termini del “chiasmo” (il “toccante-toccato”), espressa ne Il visibile e l’invisibile, sia una fonte cruciale per l’ontologia pluralista di Nancy. Il richiamo a Merleau-Ponty è volto a sottolineare come Nancy rimanga fedele a un’idea filosofica o ontologica di arte (nonostante le sue stesse critiche a questa idea), in opposizione a coloro che vorrebbero separare la sua idea pluralista di arte da qualunque riferimento alla questione del significato dell’“essere”. La mia tesi è che il pluralismo radicale richieda, paradossalmente, un’ontologia, esattamente come l’affermazione della pluralità irriducibile delle arti singolari richiede la nozione di Arte. This article reads Jean-Luc Godard’s film essay Histoire du cinéma as a contemporary artistic endeavour to resist the synchronising, standardising time of global capital, the pervasive uniformity of the global super-present, brought about by today’s televisual and digital communications, which threatens to trivialise the different processes of memory and history, as well as art and culture in general. Taking its point of departure in Bernard Stiegler’s observation that the final stage of capitalism is the control and synchronisation of “available (...) brain time,” the article argues that Godard’s work opposes this control and synchronisation of our minds through an aesthetics of contemporaneity. The argument is based on the development of a theoretical framework that combines recent theories of contemporaneity with reflections on the politics of images. Focusing on the ways in which the Holocaust is remembered in Histoire du cinéma, the article deals with Godard’s image-political creation of temporal contemporaneity through a montage of clips of old films and newsreels, photographs, stills, images of paintings, new footage, advertisements, music, sound and voice recordings, textual citation, narration and commentary. This article presents Jean-Paul Sartre’s concept of the tension between existence and politics and the role of political commitment in existentialist philosophy. Based on Sartre’s concept of engagement, the article analyzes the transition from the personal to the political perceived as a movement from personal moral consciousness to the awareness of the importance of the individual as a social actor and citizen in society. Sartre’s concept of political engagement can be characterized as critical intellectual commitment and “Socratic Citizenship.” Accordingly, (...) this article is also an acknowledgment of the two important philosophers of ecoethica, Tomonbu Imamichi and Peter Kemp, both committed public intellectuals who said that the role of the philosopher is to contribute to the public affair of cosmopolitan society. Thus, the article presents the political engagement in four major parts: (1) From the existential to political engagement, (2) Political commitment as a struggle for human freedom, (3) The Socratic Citizenship, and (4). Conditions of authentic political action. Political engagement represents an effort to realize the respect owed to each individual as a universal singular, as well as that owed to freedom and democracy in the Kingdom of Ends. (shrink)

Jean‐Francçois Lyotard was born in 1924. After teaching at the lycée Constantine in Algeria (1950–2), he returned to France and joined the group “Socialism or Barbarism” (Socialisme ou Barbarie), which had been founded in 1949 by LEFORT (see Article 44), CASTORIADIS (Article 45), and Trotskyist militants. He then lectured at the Sorbonne and at the University in Nanterre and was involved in setting up the group “Worker Power” (Pouvoir Ouvrier) when “Socialism or Barbarism” split in 1964. In Nanterre in (...) 1968, he participated in the activities of the “Movement of 22 March” (Mouvement du 22 mars) which was the origin of the student revolt in May. From 1973, he was professor at the University Paris‐VIII as well as at different American universities. The author analyzes the deconstruction of the community carried out by Jean-Luc Nancy. For Nancy, the aim of the community has been historically accomplished by its self-destruction in the “work of death” of totalitarianism. This does not lead him to renounce the notion of community, like Derrida, but to highlight its paradoxical (im-)possibility. This is why Nancy proposes the concept of a “community without community” which would retain only the cum of the communitas, the with of being-with or being (...) in-common. The author shows that this approach is subject to aporias. Indeed, Nancy wants to base being-with on an ontology of bodily touch. As he considers touching as distancing, displacement, he fails to understand the cum, that is to say the possibility of constituting a community. (shrink)

This study considers Paul Ricoeur’s theory of discourses within the context of a phenomenology of religion. I focus on the eighth study of La métaphore vive, wherein Ricoeur explores the possibility of interanimation between speculative and poetic discourses. While Ricoeur is willing to consider the interactions between religious and philosophical discourse in a number of essays, he does not develop the further possibility of the interanimation between religious and speculative thought. I take up this unexplored possibility by suggesting that metaphors (...) are capable of slipping between discourses and animating speculative and religious discourses. Specifically, I use Jean-Louis Chrétien’s metaphor of “wounding” as a case study wherein the phenomenal form of paradox defines one meaning of wounding, while another meaning is connected to a poetic expression that refers to our belonging in the world. Together, the two meanings of the metaphor enliven Chrétien’s phenomenology of religion. (shrink)

In this article first appeared in 1997, Jean-Louis Chrétien examines the meaning of prayer in Kierkegaard’s writings and existence. By focusing on the difficulties of this task and with meticulous attention to the vast work of the Danish philosopher, Chrétien describes prayer as a tense and agonistic experience, akin to the evangelical struggle between Jacob and the angel. Just like in his well-known phenomenological analysis, “The Wounded Word: Phenomenology of Prayer”, the author identifies in prayer a paradoxical articulation (...) of struggle and peace, gift and endeavour, speaking and listening, through which the human being is profoundly transformed and finally learns to truly say “thank you”. De la pierre de Jacob, décrite dans la Bible à la pierre philosophale ; des mégalithes de Stonehenge à la pierre cubique des francs-maçons, combien de fois la pierre a-telle été représentée en tant que symbole! L'auteur invite le lecteur à faire ce voyage dans l'espace et dans le temps, où, systématiquement, la pierre va se trouver associée à un événement qui a marqué l'humanité : les mégalithes, alignés dans la direction du lever du soleil aux solstices, les "pierres (...) tombées du ciel", dont on s'est demandé si elles n'étaient pas messagères des dieux ; les pierres qui guérissent, celles utilisées pour prédire l'avenir... La pierre résiste à l'usure du temps. Elle va donc servir de mémoire, de support pour transcrire les grands faits marquants qui ont ponctué notre histoire. Mais elle est aussi le matériau noble de la construction, celle avec laquelle on construit des temples pour rendre hommage aux divinités. La Franc-maçonnerie, ensuite, reprendra à son compte l'héritage et le corpus symbolique des métiers de la construction : la pierre brute, la pierre cubique, la pierre de fondation, la pierre d'angle, la clef de voûte, pour en tirer un enseignement philosophique.
